Terms of Service

1. Scope

These Terms of Service govern the sale of products through the LLM Vibe store at llm-vibe.com, operated by:

The store sells to consumers within the meaning of § 13 BGB. By placing an order, you agree to these Terms of Service.

2. Contract Formation

  • Product listings on the store are non-binding invitations to make an offer.
  • By completing checkout and confirming payment, you make a binding offer to purchase the items in your cart.
  • The contract is concluded upon our acceptance of that offer, which we communicate by sending an order confirmation email.
  • The contract text is not permanently stored by us. You will receive the essential details by email; please retain the confirmation.

3. Prices and Payment

  • Prices are shown at checkout in the currency of your selected market and are final. No value added tax (VAT) is charged, as the operator is a small business (Kleinunternehmer) under § 19 UStG.
  • Shipping costs are calculated at checkout and shown before order confirmation.
  • Accepted payment methods: card (via Shopify Payments) and PayPal.
  • Payment is due at the time of order placement.

4. Delivery

  • Products are made to order. Estimated production and shipping times are stated on each product page and typically range from 2 to 14 days.
  • Delivery is available to the following markets: European Union, United Kingdom, United States, Canada.
  • Ownership of the goods transfers to you upon delivery. Until full payment is received, we retain title to the goods (Eigentumsvorbehalt).

5. Right of Withdrawal

Consumers in the European Union and the United Kingdom have a statutory right of withdrawal. Details of the right, its exercise, and the model withdrawal form are set out in our Return and Refund Policy (llm-vibe.com/policies/refund-policy) and in the appendix to these Terms.

6. Warranty

Statutory warranty rights apply. In particular, consumers have two years from delivery to claim defects existing at the time of delivery under § 438 BGB, or the equivalent statutory period under the law of the consumer's habitual residence where more favourable to the consumer.

7. Liability

  • We are liable without limitation for damages caused by intent or gross negligence, for injury to life, body, or health, and under the German Product Liability Act (Produkthaftungsgesetz).
  • For breaches of essential contractual obligations caused by simple negligence, our liability is limited to foreseeable damages typical for this type of contract.
  • Any further liability is excluded.

8. Data Protection

Personal data is processed in accordance with our Privacy Policy (llm-vibe.com/policies/privacy-policy).

9. Dispute Resolution

The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

10. Applicable Law and Jurisdiction

  • These Terms are governed by the laws of the Federal Republic of Germany. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
  • Where the consumer's habitual residence is in an EU member state, this choice of law does not deprive the consumer of the protection of mandatory provisions of the law of their state of habitual residence.

11. Severability

If any provision of these Terms is or becomes invalid or unenforceable, the validity of the remaining provisions is unaffected.

1. Geltungsbereich

Diese Allgemeinen Geschäftsbedingungen regeln den Verkauf von Waren über den LLM Vibe Shop unter llm-vibe.com, betrieben von:

Der Shop richtet sich an Verbraucher im Sinne von § 13 BGB. Mit der Aufgabe einer Bestellung erkennen Sie diese AGB an.

2. Vertragsschluss

  • Die Darstellung der Produkte im Shop stellt kein rechtlich bindendes Angebot, sondern eine Aufforderung zur Abgabe eines Angebots dar.
  • Mit Abschluss des Bestellvorgangs und Bestätigung der Zahlung geben Sie ein verbindliches Angebot zum Kauf der im Warenkorb befindlichen Artikel ab.
  • Der Vertrag kommt mit unserer Annahme dieses Angebots zustande, die wir Ihnen durch die Bestellbestätigung per E-Mail mitteilen.
  • Der Vertragstext wird von uns nicht dauerhaft gespeichert. Die wesentlichen Angaben erhalten Sie per E-Mail; bitte bewahren Sie die Bestätigung auf.

3. Preise und Zahlung

  • Die Preise am Checkout sind in der Währung Ihres gewählten Markts angegeben und sind Endpreise. Es wird keine Umsatzsteuer erhoben, da der Betreiber Kleinunternehmer im Sinne von § 19 UStG ist.
  • Versandkosten werden am Checkout berechnet und vor Bestellabschluss angezeigt.
  • Akzeptierte Zahlungsmittel: Kartenzahlung (ĂĽber Shopify Payments) und PayPal.
  • Die Zahlung ist mit Bestellaufgabe fällig.

4. Lieferung

  • Alle Artikel werden auf Bestellung produziert. Die geschätzte Produktions- und Versandzeit ist auf jeder Produktseite angegeben und beträgt in der Regel 2 bis 14 Tage.
  • Die Lieferung erfolgt in die folgenden Märkte: Europäische Union, Vereinigtes Königreich, Vereinigte Staaten, Kanada.
  • Das Eigentum an der Ware geht mit der Ăśbergabe auf Sie ĂĽber. Bis zum vollständigen Eingang der Zahlung behalten wir uns das Eigentum an der Ware vor (Eigentumsvorbehalt).

5. Widerrufsrecht

Verbrauchern in der Europäischen Union und im Vereinigten Königreich steht ein gesetzliches Widerrufsrecht zu. Die Einzelheiten des Widerrufsrechts, seiner Ausübung und das Muster-Widerrufsformular finden Sie in unseren Rückgabebestimmungen (llm-vibe.com/policies/refund-policy) sowie im Anhang zu diesen AGB.

6. Gewährleistung

Es gelten die gesetzlichen Gewährleistungsrechte. Insbesondere haben Verbraucher innerhalb von zwei Jahren ab Lieferung das Recht, Mängel geltend zu machen, die bereits im Zeitpunkt der Lieferung bestanden haben (§ 438 BGB), oder die entsprechende gesetzliche Frist nach dem für den Verbraucher günstigeren Recht seines gewöhnlichen Aufenthalts.

7. Haftung

  • Wir haften unbeschränkt fĂĽr Schäden aus Vorsatz und grober Fahrlässigkeit, fĂĽr die Verletzung des Lebens, des Körpers oder der Gesundheit sowie nach den Vorschriften des Produkthaftungsgesetzes.
  • FĂĽr die Verletzung wesentlicher Vertragspflichten (Kardinalpflichten) durch einfache Fahrlässigkeit ist unsere Haftung auf den vertragstypisch vorhersehbaren Schaden begrenzt.
  • Eine weitergehende Haftung ist ausgeschlossen.

8. Datenschutz

Die Verarbeitung personenbezogener Daten erfolgt gemäß unserer Datenschutzerklärung (llm-vibe.com/policies/privacy-policy).

9. Streitbeilegung

Die Europäische Kommission stellt eine Plattform zur Online-Streitbeilegung unter https://ec.europa.eu/consumers/odr bereit. Wir sind nicht bereit und nicht verpflichtet, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.

10. Anwendbares Recht und Gerichtsstand

  • Es gilt das Recht der Bundesrepublik Deutschland. Das UN-Kaufrecht (CISG) findet keine Anwendung.
  • Hat der Verbraucher seinen gewöhnlichen Aufenthalt in einem Mitgliedstaat der EU, so berĂĽhrt diese Rechtswahl nicht den Schutz durch zwingende Vorschriften des Rechts seines gewöhnlichen Aufenthalts.

11. Salvatorische Klausel

Sollte eine Bestimmung dieser AGB unwirksam oder nicht durchsetzbar sein oder werden, berĂĽhrt dies die GĂĽltigkeit der ĂĽbrigen Bestimmungen nicht.
